These Terms of Service ("Terms") govern your access to and use of the website preciouscarats.com (the "Site"), our WhatsApp concierge channel, and any related sales channels operated by Precious Carats Pvt Ltd ("PreciousCarats", "we", "our", "us").

By accessing the Site, placing an order, or communicating with us about a purchase, you agree to these Terms. If you do not agree, please do not use the Site or our services.

These Terms should be read together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, which are incorporated into these Terms by reference.


1. About us

All communications under these Terms — including notices, grievances, and dispute correspondence — are handled over email at admin@preciouscarats.com.


2. Eligibility

To use the Site or place an order, you must be at least 18 years old and competent to enter into a contract under the Indian Contract Act, 1872. By placing an order, you confirm that you meet these requirements and that the information you provide is accurate and complete.


3. Products: gemstones and jewelry

3.1 Nature of natural gemstones

Natural gemstones are products of geological processes. Each stone is unique. Colour, tone, saturation, inclusions, transparency, weight, and dimensions vary from stone to stone — and on-screen rendering can vary based on your device, monitor, and lighting. The product images, videos, and descriptions on the Site are intended to faithfully represent each individual stone, but are not warranties of an exact appearance.

By placing an order, you accept that minor visual variation between on-screen representation and the physical stone is inherent to natural gemstones and is not a defect.

3.2 Treatments and disclosures

Some of our gemstones are untreated; others are treated using industry-standard methods (such as heating). Treatment status is disclosed on the product page, on the certificate, and again at the relevant points of the buying journey. You are responsible for reading these disclosures before completing a purchase.

3.3 Certification

Most loose gemstones are sold with a certification from an accredited gemmological laboratory (typically IGI, GTL, GRS, Gübelin, SSEF, or an equivalent lab named on the product page). The certificate accompanies the stone at delivery. The certificate, the pre-packing video, and the invoice together form the definitive record of the stone's identity, weight, and treatment status.

3.4 Astrological recommendations

We may, through our rashi-ratna recommendation engine or concierge service, suggest gemstones based on astrological inputs you provide. These suggestions are informational and astrological in nature; they are not medical, psychological, financial, or legal advice. Any decision to purchase a gemstone for astrological purposes is yours alone.

3.5 Custom and made-to-order jewelry

Where you order a custom piece — for example, a gemstone set into a ring, pendant, or other jewelry — production begins after Order Confirmation. Custom orders are subject to a flat 18-hour cancellation window from Order Confirmation, after which the order moves into production and cannot be cancelled. Detailed mechanics are set out in the Return & Refund Policy.


4. Pricing, taxes, and currency

  • All prices on the Site are listed in Indian Rupees (INR) unless explicitly stated otherwise.
  • Prices are inclusive or exclusive of GST as indicated at checkout. GST treatment of returns is governed by the Return & Refund Policy and applicable tax law.
  • We may change prices at any time. Once you place an order and we issue Order Confirmation, the price displayed at that point is the price applicable to your order.
  • For international orders, customs duties, import taxes, and similar charges levied by your country are your responsibility unless explicitly stated otherwise.

We reserve the right to refuse or cancel any order where a price has been displayed in error, where stock is unavailable, or where we suspect fraud — and to refund the full amount paid in such cases.


5. Order confirmation and contract formation

The display of products on the Site is an invitation to offer, not an offer of sale. Your order is an offer to purchase. A binding contract is formed only when we issue an Order Confirmation to you (over email or WhatsApp, whichever timestamp is earlier). The Order Confirmation timestamp also starts the cancellation window for custom orders under our Return & Refund Policy.


6. Payments

We accept payments through our integrated gateways — including PayU via Shopflo (domestic) and Razorpay (international). EMI options, wherever displayed, are subject to your card-issuer's terms. We do not store full card or UPI credentials on our servers; payment data is handled by the gateway.

We may use third-party fraud-prevention services on high-value transactions and reserve the right to delay or refuse dispatch if a payment is flagged for verification.


7. KYC for high-value orders

For high-value orders, international shipments, and any transaction that attracts identity verification or reporting obligations under Indian tax, customs, or anti-money-laundering law, we may request a government-issued ID, PAN, address proof, or equivalent documents before dispatching the order.

If KYC is required and not provided within a reasonable period, we may cancel the order and refund the amount paid, subject to gateway-fee absorption as described in our Return & Refund Policy.


8. Shipping and risk of loss

Shipment is governed by our Shipping Policy. In summary:

  • We ship via insured carriers, including Jewellers Block-aligned partners such as BVC Logistics for high-value consignments, and shipping aggregator services such as Shiprocket together with its empanelled courier partners (including Blue Dart, Delhivery, DTDC, Ekart, Xpressbees, and other partner couriers) with declared-value insurance for lower-value consignments.
  • Risk of loss passes to you upon delivery to the address you have specified, subject to the pre-packing video and tamper-evident packaging procedures described in the Shipping Policy and Return & Refund Policy.
  • Tampered or damaged packaging at delivery must be flagged to us in line with the Return & Refund Policy.

9. Returns, refunds, and exchanges

Returns, refunds, and exchanges are governed by the Return & Refund Policy, which forms part of these Terms. Key principles:

  • Custom jewelry: flat 18-hour cancellation window from Order Confirmation. After that, custom orders are non-cancellable.
  • Loose gemstones (domestic orders): 10-day return window. Original certificate and invoice are mandatory; original packaging is preferred but not essential.
  • International orders are final sale and are not eligible for return, refund, or exchange, except where local consumer law in the buyer's country mandates a statutory return window — in which case we will comply with the minimum legal requirement of that jurisdiction.
  • Exchanged stones are final sale and cannot be returned again.
  • The certificate and pre-packing video together form the definitive record for any return or dispute.
  • Payment-gateway fees are absorbed by us and are not deducted from refunds.
  • We do not engage external lab arbitration on returns.

10. Use of the Site

You agree not to:

  • Use the Site for any unlawful, fraudulent, or harmful purpose.
  • Reverse-engineer, scrape, or harvest data, images, or content from the Site without our written consent.
  • Upload or transmit malicious code, spam, or content that infringes any third-party rights.
  • Impersonate any person or misrepresent your affiliation with any individual or entity.
  • Interfere with the security or integrity of the Site, or attempt unauthorised access.

We may suspend or terminate your access if you breach these Terms or if your activity threatens our buyers, our business, or our service providers.


11. Intellectual property

All content on the Site — including text, photographs, videos, illustrations, logos, branding, gemstone descriptions, blog content, and the design of the Site itself — is owned by or licensed to Precious Carats Pvt Ltd and is protected under Indian and international intellectual-property laws.

You may view and download content only for personal, non-commercial use. Any other use — including reproduction, redistribution, framing, mirroring, or commercial use — requires our prior written consent. 


12. WhatsApp and other communications

When you transact with us, you consent to receive transactional messages from us over WhatsApp, email, and SMS — including order confirmations, shipment updates, certificate delivery, return coordination, and pre-packing videos.

Marketing communications are sent only where you have opted in and can be stopped at any time by replying "STOP" on WhatsApp, unsubscribing from email, or writing to admin@preciouscarats.com.


13. Third-party services and links

The Site relies on third-party services — including Shopify, our payment gateways, logistics partners, certification labs, analytics providers, and our WhatsApp concierge platform. The Site may also link to third-party websites. We are not responsible for the availability, content, or practices of those third parties. Your use of any third-party service is subject to that provider's own terms.


14. Disclaimers

To the maximum extent permitted by law:

  • The Site is provided on an "as is" and "as available" basis. We do not warrant that the Site will always be uninterrupted, error-free, or secure.
  • We do not warrant any astrological outcome, energetic effect, planetary remedy, or financial appreciation in connection with the purchase or wearing of any gemstone.
  • Investment value of gemstones, where mentioned editorially, is not a forecast or guarantee.

Nothing in these Terms limits any liability that cannot be limited under the Consumer Protection Act, 2019 or other mandatory Indian law.


15. Limitation of liability

Subject to applicable law, our total aggregate liability to you in respect of any claim arising out of or in connection with your use of the Site or any order — whether in contract, tort, statute, or otherwise — shall not exceed the total amount actually paid by you for the specific order giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of opportunity, or reputational loss.


16. Indemnity

You agree to indemnify and hold harmless Precious Carats Pvt Ltd, its directors, employees, and service providers against any claims, damages, losses, or expenses arising out of:

  • Your breach of these Terms;
  • Your misuse of the Site or our services;
  • Your violation of any applicable law in connection with your use of the Site.

17. Force majeure

We are not liable for any delay or failure in performance caused by events beyond our reasonable control — including acts of God, natural disasters, pandemics, government action, customs delays, civil unrest, strikes, courier disruption, banking-system outages, or internet failures.


18. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Material changes will be notified on the Site or by email. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.


19. Governing law and jurisdiction

These Terms and any dispute, claim, or grievance arising out of or in connection with them (including their existence, validity, interpretation, performance, breach, or termination) shall be governed by and construed in accordance with the laws of India.

Subject to the statutory rights and remedies available to you under the Consumer Protection Act, 2019, the Digital Personal Data Protection Act, 2023, and other applicable Indian law, the courts and tribunals located within the National Capital Territory of Delhi shall have exclusive jurisdiction over any such dispute, claim, or grievance, and you and Precious Carats Pvt Ltd irrevocably submit to the exclusive jurisdiction of such courts and tribunals.


20. Grievance redressal

For any complaint or grievance under these Terms, the IT Act, 2000, the Consumer Protection Act, 2019, or the Consumer Protection (E-Commerce) Rules, 2020:

Response timelines:

  • We will acknowledge any complaint or grievance within 48 hours of receipt.
  • We will resolve the complaint or grievance within 30 days of receipt, in line with applicable law.

For grievance and dispute correspondence, email is our official channel because it allows us to verify, track, and respond to requests securely. Requests made by phone or informal channels may be redirected to email before they can be acted upon.
